Metal Wall Art Affiliate Program Terms of Service

Agreement

By enrolling as an Affiliate in the Metal Wall Art Affiliate Program (“Program”), you agree to abide by these Terms of Service (“Terms”). These Terms form a binding agreement between you and Metal Wall Art.

We may update these Terms periodically without prior notice. Any enhancements or new features added to the Program will also be governed by these Terms. Your continued participation in the Program after changes are made signifies your acceptance of the updated Terms.

Breaching any of these Terms will lead to the termination of your Affiliate account and forfeiture of any unpaid commissions earned during the violation. Participation in the Program is at your own risk.

Account Terms

• Only human individuals or legal entities may register. Automated accounts created by bots are prohibited.
• You must provide your full legal name, a valid email address, and all requested information to complete registration.
• You are responsible for securing your account and password. Metal Wall Art is not liable for losses resulting from your failure to maintain account security.
• You are accountable for all content posted and activities conducted through your account.
• Each individual or entity is limited to one account.
• The Program must not be used for illegal or unauthorized purposes, including violations of copyright or other laws in your jurisdiction.

Affiliate Links, Graphics, and Promo Codes

Upon joining the Program, you will receive a unique Affiliate Code. You may use provided links, banners, or graphics containing your Affiliate Code on your website, emails, or other communications. Metal Wall Art will supply guidelines, link formats, and artwork for linking to https://www.metalwallart.co.za. We may update artwork designs at any time, but significant changes to image dimensions will be communicated in advance.

For accurate tracking and commission accrual, you must use the special link formats (“Special Links”) provided by us. Commissions are earned only on sales of Metal Wall Art products generated directly through Special Links. We are not responsible for commissions lost due to incorrect use of Special Links or improper entry of your Affiliate Code.

Alternatively, you may use unique promo codes provided by Metal Wall Art to accrue commissions. These promo codes, which may offer customers benefits such as a 10% discount, allow affiliates to earn commissions on sales without requiring Special Links. Customers using promo codes are subject to our Vouchers and Coupons Terms and Conditions. Metal Wall Art reserves the right to modify or discontinue promo code benefits at any time without notice.

Commissions and Payment

To earn a commission, a customer must complete a purchase on https://www.metalwallart.co.za either by clicking a Special Link from your site, email, or other communication or by using a provided promo code. Commissions are paid monthly via PayPal, provided your earnings exceed R500. Commissions are only eligible for payment after the 7-day refund period for the associated purchase has expired, ensuring the sale is final.

Commissions are only paid on sales tracked automatically by our systems through properly formatted Special Links or valid promo codes. We strive to ensure accurate tracking but are not liable for untracked sales due to technical errors. Commissions earned through fraudulent, illegal, or overly aggressive marketing tactics may be disqualified. No commissions are paid on refunded or disputed orders. We reserve the right to review and approve commissions and may suspend or remove Affiliates at our discretion.

Prohibited Marketing Practices

Affiliates must not engage in the following practices, which may result in commission disqualification or account termination:

• Spamming, including unsolicited emails or messages that violate South Africa’s Protection of Personal Information Act (POPIA) or anti-spam laws.
• Using coupon or deal sites to promote Metal Wall Art without prior written approval.
• Bidding on Metal Wall Art’s brand name, trademarks, or variations (e.g., “Metal Wall Art,” “MetalWallArt”) in pay-per-click (PPC) advertising campaigns.
• Posting affiliate links or promo codes on social media platforms in a manner that misrepresents the product or violates platform guidelines.
• Using deceptive or misleading advertising tactics, such as false discounts or unauthorized claims about Metal Wall Art products.

Representing Metal Wall Art

You may not issue press releases or public statements about your participation in the Program without prior written consent from Metal Wall Art, as this may lead to termination. You must not misrepresent your relationship with Metal Wall Art, claim to develop our products, or imply any affiliation beyond what is outlined in these Terms. This includes suggesting that Metal Wall Art endorses or supports any cause or entity unless explicitly authorized.

Purchasing products through your own Affiliate links or promo codes for personal use is prohibited and may result in withheld commissions or account termination.

Customer Policies

Customers purchasing through the Program are considered Metal Wall Art customers. Our policies on orders, customer service, and sales apply to these customers. We may update these policies at any time without notice.

Your Responsibilities

You are solely responsible for:

• Developing, operating, and maintaining your website and related equipment.
• Ensuring Special Links and promo codes comply with any third-party agreements (e.g., hosting provider terms).
• The accuracy and legality of all content on your site, including product-related materials and information associated with Special Links or promo codes.
• Ensuring your site’s content does not infringe on third-party rights (e.g., copyrights, trademarks, or privacy).
• Disclosing how you collect, use, store, and share visitor data, including third-party advertising or cookie usage, via a privacy policy or similar notice.

Compliance with Laws

You must comply with all applicable laws, regulations, and governmental requirements in your jurisdiction while participating in the Program. This includes, but is not limited to, email marketing laws such as South Africa’s Protection of Personal Information Act (POPIA) and anti-spam regulations.

Term and Termination

This agreement begins when your Program application is accepted and continues until terminated by either party. You or Metal Wall Art may end this agreement at any time, with or without cause. Upon termination, you must immediately remove all links to https://www.metalwallart.co.za, as well as our trademarks, logos, promo codes, and provided materials. If the Program is discontinued, earned commissions above R500 will be paid, provided no Terms violations occurred.

Metal Wall Art may suspend or terminate your account at its discretion, resulting in the loss of access to the Program and forfeiture of commissions if earned through prohibited methods.

Relationship of Parties

You and Metal Wall Art are independent contractors. This agreement does not establish a partnership, joint venture, agency, or employment relationship. You have no authority to make commitments or representations on our behalf.

Limitations of Liability

Metal Wall Art is not liable for indirect, special, or consequential damages (e.g., loss of profits or data) arising from this agreement or the Program, even if advised of such possibilities. Our total liability will not exceed the commissions paid or payable to you under this agreement.

Disclaimers

We make no warranties, express or implied, regarding the Program or products sold through it, including fitness for purpose, merchantability, or non-infringement. We do not guarantee uninterrupted or error-free operation of the Metal Wall Art website, and we are not liable for any resulting consequences.

Independent Evaluation

By participating, you confirm that you have read and agree to these Terms. You acknowledge that Metal Wall Art may solicit customer referrals on different terms or operate websites that compete with yours. Your participation is based on your independent evaluation, not on any external representations or guarantees.

Dispute Resolution

Any disputes arising from this agreement or your participation in the Program will be resolved through confidential arbitration under the rules of the Arbitration Foundation of Southern Africa (AFSA). However, if you violate or threaten our intellectual property rights, we may seek injunctive relief in any competent court. Arbitration awards are binding and enforceable in court. Disputes will not be combined with those of other parties.

Miscellaneous

This agreement is governed by the laws of South Africa, excluding conflict-of-law principles. You may not assign this agreement without our written consent. Our failure to enforce any provision does not waive our right to enforce it later. These Terms constitute the entire agreement between you and Metal Wall Art, superseding any prior agreements.
